President’s Budget Submission

Under section 1105 of title 31 the U.S. Code, the President is legally required by “the first Monday in January but not later than the first Monday in February of each year” to submit a budget for the upcoming fiscal year to Congress. Section 1106 of the Code sets forth a further legal requirement for the President to submit an update to the budget, which must occur before July 16 of each year. This document is commonly known as the “Mid-Session Review”.

The President’s budget was late since it arrived on Monday, February 12, 2018 (not the “first Monday in February”). The “current services” budget, which is included in the President’s submission, is actually required by law “On or before the first Monday after January 3 of each year” (as mandated in 31 U.S.C. 1109), though Presidents have refused to comply with that part of the law for decades.
