Section 113

TITLE I—BUDGET ENFORCEMENT

Subtitle B—Establishing a Congressional Budget

Sec.113. Rule of construction in the House of Representatives.

In the House of Representatives, for the remainder of the 113th Congress, the provisions of H. Con. Res. 25 (113th Congress), as deemed in force by H. Res. 243 (113th Congress),[1] shall remain in force to the extent its budgetary levels are not superseded by this subtitle or by further action of the House of Representatives.

[1] H. Res. 243 (113th Congress) deemed H. Con. Res. 25 (113th Congress) to be in force as though it had been adopted as a full budget resolution. Section 3 of H. Res. 243 read as follows: 

Sec. 3. Pending the adoption of a concurrent resolution on the budget for fiscal year 2014, the provisions of House Concurrent Resolution 25, as adopted by the House, shall have force and effect in the House as though Congress has adopted such concurrent resolution, and the allocations of spending authority printed in Tables 11 and 12 of House Report 113–17 shall be considered for all purposes in the House to be the allocations under section 302(a) of the Congressional Budget Act of 1974.

Committee Print STATEMENT (BBA 2013)

The House Committee on the Budget issued a Committee Print for the Bipartisan Budget Act of 2013 (113th Congress). It included this description:

Sec. 113. Rule of construction in the House of Representatives.

Section 113 provides that H. Con. Res. 25 (113th Congress), the budget resolution for fiscal year 2014 as placed in force by H. Res. 243 (113th Congress), remains in force to the extent that its budgetary levels have not been superseded by this subtitle or further action of the House. Items that remain in force include the recommended levels contained in Title III, the reserve funds in Title IV, the estimates of direct spending in Title V, the budget enforcement matters in Title VI, and the policy statements in title VII of that concurrent resolution. This matter will remain in force until the adoption of a subsequent concurrent resolution on the budget or the end of the 113th Congress, unless they are carried into the 114th Congress by an act of the House.
