Clause 1 of Rule XXI
Rules XXI of the House of Representatives
Reservation of certain points of order
§1035. Reservation of points of order.
1. At the time a general appropriation bill is reported, all points of order against provisions therein shall be considered as reserved.
House Rules and Manual Notes
This clause was added in the 104th Congress (sec. 215(e), H. Res. 6, Jan. 4, 1995, p. 468), rendering unnecessary the former practice that a Member reserve points of order when a general appropriation bill was referred to the calendar of the Committee of the Whole House on the state of the Union, in order that provisions in violation of rule XXI could be stricken in the Committee of the Whole (see §1044, infra [clause 2, rule XXI]). Before the House recodified its rules in the 106th Congress, this provision was found in former clause 8 of rule XXI (H. Res. 5, Jan. 6, 1999, p. 47).
Counsel Notes
The recodification did not alter the clause and solely moved prior clause 8 to it current place as clause 1. See the following:
Former Clause 8 of Rule XXI from the 105th Congress
§ 848a. Reservation of points of order.
8. At the time any appropriation bill is reported, all points of order shall be considered as reserved.
House Rules and Manual Notes
Clause 8 was added in the 104th Congress (sec. 215(e), H. Res. 6, Jan. 4, 1995, p. ——), rendering unnecessary the former practice that a Member reserve points of order when a general appropriation bill was referred to the calendar of the Committee of the Whole House on the state of the Union, in order that provisions in violation of rule XXI could be stricken in the Committee of the Whole (see § 835, supra).
