SEC. 222 CURRENT SERVICES BUDGET FOR CONGRESSIONAL BUDGET PURPOSES.[1]

(a) Current Services budget.—The first sentence of section 1109(a) of title 31, United States Code, is amended by striking out “Before November 11 of each year” and inserting in lieu thereof “On or before the first Monday after January 3 of each year (on or before February 5 in 1986)”.

(b) Joint Economic Committee Review.—Section 1109(b) of title 31, United States Code, is amended by striking out “January 1” and inserting in lieu thereof “March 1”.

[1] This section requires the President to submit a current services budget on an earlier date than the current latest allowable date for the budget submission under 31 USC 1105(a). The President has not submitted the current services budget by this date since the Budget Enforcement Act of 1990 changed the latter budget submission’s date.

Explanatory Notes

Section 606 of the Congressional Budget Act of 1974 originally required the Current Services budget to be submitted by the Congress to Congress on November 10 of each year to correspond with the January 3 Presidential submission date for his full budget, which is now required under 2 U.S.C. 1105. When the full budget submission was pushed back to the First Monday in February by the Budget Enforcement Act of 1990, the current services budget, though it’s submission date was not changed by that Act, has not been submitted by the President by the  January 3 date as required under this amended section.

The Joint Explanatory Statement of the Managers of Conference on the Balanced Budget and Emergency Deficit Control Act of 1985 included this description:

Section 222. Current Services Budget for Presidential Budget Purposes

The House amendment contained an amendment to section 1109(a) of title 31, United States Code.

The Senate amendment contained no such amendment.

The conference agreement contains the House language amending section 1109(a) of title 31, United States Code, to require the President to submit a current services budget concurrently with the annual budget submission on or before the first Monday following January 3 of each year, except for calendar year 1986 when the deadline is February 5.

The conference agreement also makes a corresponding change that the Joint Economic Committee submits its analysis of the current services budget on March 1.
