Concurrent Resolution on the Budget for Fiscal Year 2019

No formal budget resolution was adopted by Congress
Legislative History
Though Congress failed to formally adopt a concurrent resolution on the budget for fiscal year 2019, deeming resolution language became effective with the enactment of the Bipartisan Budget Act of 2018 (Pub. L. 115-123), which allowed for budget enforcement in the House and the Senate. See “Deeming Resolutions” serving as a budget for each House of Congress in lieu of a budget resolution. These are resolutions or laws that take the place of a formal budget resolution adopted, and allow each chamber a method to enforce the Congressional Budget Act of 1974 as if Congress had fulfilled its terms.
The House marked up and reported H. Con. Res. 128 (115th Congress), but it was not considered on the floor of the House of Representatives.
The Senate Budget Committee did not mark up a concurrent resolution on the budget and was discharged of its duties pursuant to section 300 of the Congressional Budget Act of 1974. Senator Rand Paul (R-KY) introduced S. Con. Res. 36 (115th Congress), a concurrent resolution on the budget for fiscal year 2019. He made a motion to proceed on the consideration of that concurrent resolution but it was defeated: Yea-Nay Vote. 21 – 76. Record Vote Number: 99. The debate on the motion was considered on May 17, 2018.
Deeming Resolution Language
The following sections are included in the Bipartisan Budget Act of 2018 (Pub. L. 115-123), and provided for enforcement of the budgetary levels resulting from that agreement between the Congress and President Trump:
Section 30103. Authority for fiscal year 2019 budget resolution in the Senate.
Section 30104. Authority for fiscal year 2019 budget resolution in the House of Representatives.
