Legislative History

Fiscal year 1999 was the first year since the enactment of the Congressional Budget Act of 1974 a budget resolution had not been formally adopted by the Congress. It would not be the last. The reasons for a failure to come to agreement between the House and Senate are not entirely clear, but the primary reason is likely the disagreement between the Budget Chairmen.

In 1997, the two Committees spearheaded the balanced budget agreement between Congress and President William Clinton that led to the enactment of the Balanced Budget Act of 1997 (which carried the Budget Enforcement Act of 1997 in title X). Since the agreement had just been reached the previous year, and it had been accomplished through the use of reconciliation procedures, Senator Pete Domenici believed that the deal should remain in force for a period of time before another reconciliation bill should be employed. Chairman Kasich felt that the budget required constant attention and that another attempt should be made immediately.

As a result, the House and Senate could not reach an agreement on a conference report. Instead a resolution was adopted that “deemed” an amount in force for the discretionary spending amount, tantamount to a 302(a) allocation under the Congressional Budget Act of 1974. When the 106th Congress was convened, the House included the authority for Budget Chairman Kasich to include in the record a full set of allocations and aggregate levels to serve as a more complete “deeming resolution”.
