sec. 273. revenue estimates.[1] [Transferred to section 201 of CBA]

[For the purposes of revenue legislation which is income, estate and gift, excise, and payroll taxes (i.e., Social Security), considered or enacted in any session of Congress, the Congressional Budget Office shall use exclusively during that session of Congress revenue estimates provided to it by the Joint Committee on Taxation. During that session of Congress such revenue estimates shall be transmitted by the Congressional Budget Office to any committee of the House of Representatives or the Senate requesting such estimates, and shall be used by such Committees in determining such estimates. The Budget Committees of the Senate and House shall determine all estimates with respect to scoring points of order and with respect to the execution of the purposes of this title and the Congressional Budget and Impoundment Control Act of 1974.]

[1] Section 13202(b) of the Budget Enforcement Act of 1990 transferred this section which relates to the Congressional Budget Office to section 201(f) of the Congressional Budget Act of 1974. The text here reflects section 273 of the Balanced Budget and Emergency Deficit Control Act of 1985  as enacted. The language in the Congressional Budget Act of 1974 is similar, but not verbatim.

Codification

Before it was transferred, this section was classified at sec. 921. of the U.S. Code. It was originally enacted in the Balanced Budget and Emergency Deficit Control Act of 1985 (BBEDCA) ( Pub. L. 99–177, title II, §273, Dec. 12, 1985, 99 Stat. 1098) and related to revenue estimates. Section 13202(b) of BEA 1990 (Pub. L. 101–508) redesignated it as section 201(g) of the Congressional Budget Act of 1974, in title II, which sets forth the Congressional Budget Office. The section is currently classified to the U.S. Code at 2 U.S.C. 601(f).

The text from the BEA 1990 that transferred the text from section 272 is as follows (emphasis added):

SEC. 13202. CODIFICATION OF PROVISION REGARDING REVENUE ESTIMATES.

(a) Redesignation.—Section 201 of the Congressional Budget Act of 1974 is amended by redesignating subsection (f) as subsection (g).

(b) Transfer.—The text of section 273 of the Balanced Budget and Emergency Deficit Control Act of 1985 is transferred to section 201 of the Congressional Budget Act of 1974 as subsection (g).[2]

(c) Conforming Changes.—Section 201(g) of the Congressional Budget Act of 1974 (as redesignated by subsection (b)) is amended by–

(1) striking “this title and the Congressional Budget and Impoundment Control Act of 1974” and inserting “this Act”; and

(2) inserting “Revenue Estimates.—”  before the first sentence.

[2] This reference should be “(f)” rather than “(g)”. The transferred text should have been redesignated as section 201(f) of the Congressional Budget Act of 1974. This was corrected in section 201 by section 10102(c) of the Budget Enforcement Act of 1997 (Pub. L. 105-33) and currently read accurately.
