TITLE IV—ADDITIONAL PROVISIONS TO IMPROVE
FISCAL PROCEDURES

Sec. 406.[1] [2] The Speaker of the House of Representatives, after consulting with the Minority Leader of the House, may appoint a Member User Group for the purpose of reviewing budgetary scorekeeping rules and practices of the House and advising the Speaker from time to time on the effect and impact of such rules and practices.

[2] Section 214 of the Balanced Budget and Emergency Deficit Control Act of 1985 amended the Congressional Budget Act of 1974 by adding three new sections at the end: §§405, 406, and 407. These were subsequently renumbered by the Budget Enforcement Act of 1997.

A “Member Group” has never been established pursuant to this section.
Conference Report on BBEDCA
The Balanced Budget and Emergency Deficit Control Act of 1985 (BBEDCA) originally established this as section 407. It was renumbered as section 406 by sec. 10116 of the Budget Enforcement Act of 1997.
In the Explanatory Statement of Managers on H. J. Res. 372 (BBEDCA), as reported from conference, stated the following:
Section 407. Member User Group.
This Section allows the Speaker, after consultation with the Minority Leader, to appoint a Member User Group, which shall review the scorekeeping rules and practices of the House and report to the Speaker from time to time on their effect and impact.

Pub. L. 99–177, title II, §214, Dec. 12, 1985, 99 Stat. 1060. The Balanced Budget and Emergency Deficit Control Act of 1985) added three new sections to the Congressional Budget Act of 1974 (Pub. L. 93–344, title IV), those being sections 405, 406, and 407. This section was at that time numbered as section 407, but was later redesignated as section 406.
Pub. L. 105–33, title X, §10116(c)(1), Aug. 5, 1997, 111 Stat. 692 (Budget Enforcement Act of 1997), after repealing section 402 of the Budget Act, renumbered sections 403 through 407 as sections 402 through 406.
Amendments
1997
Pub. L. 105–33, title X, §10116(c)(1), Aug. 5, 1997, 111 Stat. 692 redesignated this section as section 406 (from section 407). Subsection (c) of section 10116 of the Budget Enforcement Act of 1997 (BEA 1997) included the following text:
(1) Redesignation.—Sections 403 through 407 of the Congressional Budget Act of 1974 are redesignated as sections 402 through 406, respectively.
Prior Provisions
A prior section 406 of Pub. L. 93–344 (Congressional Budget Act of 1974) was renumbered section 405 of that Act by the BEA 1997. It is classified to section 655 of Title 2, U.S. Code.
Effective Date
This section was first effective December 12, 1985, and applicable to fiscal years beginning after Sept. 30, 1985. Section 275(a)(1) of Pub. L. 99–177 (BBEDCA), formerly set out an Effective and Termination Dates. Section 275 was repealed by the Budget Control Act of 2011 (Pub. L. 112–25, title I, §104(a), Aug. 2, 2011, 125 Stat. 246).
